Competition law is one of the foundations on which current European law is built. Fair competition in the single market is not only of great importance for the competing businesses in that market but it also benefits consumers.
Both the European Commission and the Netherlands Authority for Consumers and Markets (ACM) therefore have broad powers to act against cartels and abuse of power. To prevent the creation of excessively powerful companies and monopolies, mergers and acquisitions above a certain threshold must be notified to (and approved by) the authorities in advance. We help clients with these notifications for a smooth settlement of this sort of transaction.
We also advise clients who want to enter into collaborations with other companies, to prevent them from unexpectedly entering into prohibited arrangements, including price-fixing arrangements, with competitors or otherwise violating competition law. We also provide clients who suspect that their competitors are enjoying an unfair advantage with advice on the options available to them under competition law.
